But if ‘common sense’ is “the idea that individuals should not attack, kill, steal from, or defraud one another” then I would argue that there are not “so few societies” built on it, but that it is the norm for all societies, formal and informal. It is not surprising, in exploring what was obvious to the skilled person, that tensions arise between the urge to invoke “common sense”, the danger of being influenced by hindsight knowledge of the claimed subject matter, and the need for evidence before one finds a duly issued claim invalid.
